Welcome to BSZN. BSZN is a trading name of BSZN TRADING SERVICES LIMITED. The terms “we,” “us,” and “our” refer to BSZN TRADING SERVICES LIMITED, trading as BSZN (“BSZN”). BSZN operates this store and website, including all related information, content, features, tools, products, and services, to provide you, the customer, with a curated shopping experience (the “Services”). BSZN is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced in them (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you must not use or access the Services.

Nothing in these Terms excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded, restricted, or modified under applicable law.

Section 1 — Access and Account

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, or country of residence, or that you are the age of majority in your place of residence and have given us your consent to allow any of your minor dependants to use the Services on devices you own or manage.

To use the Services, including browsing our online store or purchasing products or services, you may be asked to provide information such as your email address and billing, payment, and shipping details. You represent and warrant that all information you provide is accurate, current, and complete, and that you have all rights necessary to provide it.

You are responsible for maintaining the confidentiality and security of your account credentials and for all activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

Section 2 — Our Products

We make reasonable efforts to display and describe our products and services accurately. However, colours, textures, finishes, proportions, and other aspects of a product may appear differently on your screen because of your device, display settings, lighting, or photography.

Product images are provided for reference. Minor variations may occur where products include handcrafted, washed, distressed, printed, embroidered, or otherwise individually finished elements. These variations are not defects unless they cause the product to fail to meet its description or applicable quality requirements.

Except where required by applicable law, we do not warrant that a product’s appearance will exactly match its on-screen representation or your subjective expectations.

Product descriptions may be updated without notice. We reserve the right to discontinue a product at any time and, where permitted by law, to limit the quantities offered to any person, household, geographic region, or jurisdiction on a case-by-case basis.

Section 3 — Orders

When you place an order, you make an offer to purchase the products in that order. BSZN may accept or decline your order for a legitimate reason, including product unavailability, suspected fraud, payment failure, pricing or description errors, shipping restrictions, or a breach of these Terms. Your order is not accepted until BSZN sends you confirmation of acceptance. We must receive and process your payment before accepting the order.

Please review your order carefully before submitting it. Once an order has been accepted, we may be unable to accommodate a cancellation or amendment request. If we decline, change, or cancel an order, we will attempt to notify you using the email address, billing address, or telephone number provided with the order. If payment has already been taken for an order that we do not accept or later cancel, we will refund the relevant amount using the original payment method, subject to applicable law and payment-provider processing times.

Returns and exchanges are governed by our Refund Policy and any rights available to you under applicable law.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or unlawful export.

Section 4 — Prices and Billing

Prices, discounts, and promotions may change without notice. The price charged for a product or service will be the price shown when you place your order, subject to correction of genuine errors as described in Section 12, and will be stated in your order confirmation.

Unless otherwise stated, shipping, handling, customs duties, import taxes, and similar charges are not included in the product price and may be payable by you. Applicable taxes and other charges will be displayed, calculated, or disclosed as required by law and according to the delivery destination and checkout method. Where applicable law requires prices to include taxes or other mandatory charges, the displayed price will include them.

Prices in our online store may differ from prices offered through a physical store, marketplace, pop-up, or other third-party channel. Promotions may be governed by separate terms. If promotion terms conflict with these Terms, the promotion terms will apply to that promotion.

You agree to provide current, complete, and accurate purchase, payment, and account information and to update that information promptly so that we can complete transactions and contact you when necessary.

You represent and warrant that: (i) the payment information you provide is true, accurate, and complete; (ii) you are authorised to use the selected payment method; (iii) charges you incur will be honoured by your payment provider; and (iv) you will pay all charges properly disclosed in connection with your order, including applicable shipping charges and taxes.

Section 5 — Shipping and Delivery

Shipping methods, estimated fulfilment times, and estimated delivery times are described at checkout or in our Shipping Policy. Delivery dates are estimates unless we expressly state otherwise or applicable law requires a specific deadline.

We are not responsible for delays caused by carriers, customs authorities, incorrect or incomplete delivery information supplied by you, or events outside our reasonable control. We will provide notices and remedies for material delays where required by applicable law.

Unless applicable law provides otherwise, risk of loss of or damage to a product passes to you when the product is delivered to you or to a person you designate to receive it. If you independently appoint a carrier that we did not offer, risk may pass when the product is delivered to that carrier, to the extent permitted by applicable law.

Section 6 — Intellectual Property

The Services, including all trademarks, brand elements, text, displays, images, graphics, product reviews, video, audio, and the design, selection, and arrangement of those materials, are owned by BSZN, its affiliates, or its licensors and are protected by applicable copyright, trademark, design, and other intellectual property laws and international treaties.

These Terms permit you to use the Services for personal, non-commercial purposes only. Without our prior written consent, you must not reproduce, distribute, modify, create derivative works from, publicly display or perform, republish, download, store, or transmit material from the Services, except where such use is permitted by law.

Except as expressly stated in these Terms, nothing grants you any licence or other right under any patent, trademark, copyright, design right, or other intellectual property right belonging to BSZN, Shopify, or any third party. All rights not expressly granted are reserved.

BSZN’s names, logos, product and service names, designs, and slogans are trademarks or other protected brand assets of BSZN or its affiliates or licensors. You must not use them without BSZN’s prior written permission. Shopify’s name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans appearing through the Services are the property of their respective owners.

Section 7 — Optional Tools

We may provide access to tools offered by third parties as part of the Services. We do not monitor or control those tools and may have no input into their operation.

To the extent permitted by law, access to optional third-party tools is provided “as is” and “as available,” without warranties, representations, conditions, or endorsement of any kind. We are not liable for loss arising solely from your use of an optional third-party tool that we do not operate or control.

Your use of optional tools is at your own discretion. You should review and understand the terms and privacy practices of the relevant third-party provider before using them.

We may introduce new features, tools, and resources through the Services. Those features will form part of the Services and will be subject to these Terms unless separate terms are stated.

Section 8 — Third-Party Links

The Services may contain materials, embedded functionality, or links to websites operated by third parties. We are not responsible for examining or evaluating the content, security, or accuracy of third-party materials or websites. If you leave the Services to access a third-party website, you do so at your own risk.

To the extent permitted by law, we are not liable for harm or loss arising from your access to a third-party website or your purchase or use of products, services, resources, or content offered by a third party. Review the third party’s policies and practices before completing any transaction. Complaints or questions concerning third-party products or services should be directed to that third party.

Section 9 — Relationship with Shopify

BSZN is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with BSZN. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and BSZN, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with BSZN.

Section 10 — Privacy Policy

Personal information we collect through the Services is governed by our Privacy Policy. Certain personal information may also be governed by Shopify’s Consumer Privacy Policy. By using the Services, you acknowledge that you have had the opportunity to read these privacy policies.

Because Shopify hosts the Services, Shopify collects and processes personal information about your access to and use of the Services to provide and improve the Services. Information you submit may be transmitted to and shared with Shopify and service providers located in countries or regions other than your place of residence. Please review our Privacy Policy for more information about how BSZN, Shopify, and our service providers collect, use, disclose, and transfer personal information.

Section 11 — Feedback

If you submit, upload, post, email, or otherwise transmit ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, “Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display that Feedback in any medium for any lawful purpose, including commercial purposes. We may use Feedback to operate, evaluate, improve, and promote the Services and to exercise our rights and perform our obligations under these Terms.

You represent and warrant that: (i) you own or have all rights necessary to submit the Feedback and grant this licence; (ii) you have disclosed any compensation or incentive received in connection with the Feedback; and (iii) the Feedback complies with these Terms and applicable law.

We are not required to keep Feedback confidential, pay compensation for it, or respond to it, except where required by law or separately agreed in writing.

We may, but are not required to, monitor, edit, or remove Feedback that we reasonably determine is unlawful, offensive, threatening, defamatory, obscene, misleading, infringing, or otherwise objectionable, or that violates another person’s rights or these Terms.

Your Feedback must not violate any third party’s rights, including copyright, trademark, privacy, publicity, personality, or other personal or proprietary rights. It must not contain unlawful, abusive, obscene, or malicious content, computer viruses, or other malware. You must not use a false email address, impersonate another person, or mislead us or third parties about the origin of Feedback. You are responsible for the Feedback you submit and its accuracy. To the extent permitted by law, we accept no responsibility for Feedback posted by you or a third party.

Section 12 — Errors, Inaccuracies, and Omissions

The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. Subject to applicable law, we may correct errors, inaccuracies, or omissions and update information at any time without prior notice.

If an error materially affects an order you have submitted, we may contact you to confirm whether you wish to proceed on the corrected basis or cancel the affected order. If we cancel an accepted order because of an error, we will refund the amount paid for the affected product using the original payment method.

Section 13 — Prohibited Uses

You may access and use the Services only for lawful purposes. You must not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, national, federal, provincial, state, territorial, or local law or regulation; (c) to infringe our intellectual property rights or the rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, or intimidate any person; (e) to transmit false or misleading information; (f) to send, receive, upload, download, use, or reuse material that does not comply with these Terms; (g) to transmit or procure unsolicited advertising or promotional material, including junk mail, chain letters, spam, or similar solicitations; (h) to impersonate or attempt to impersonate another person or entity; or (i) to engage in conduct that restricts or inhibits another person’s use or enjoyment of the Services or that may harm BSZN, Shopify, or users of the Services, or expose them to liability.

You also agree not to: (a) upload or transmit viruses or other malicious code; (b) reproduce, duplicate, copy, extract, sell, resell, or exploit any portion of the Services without permission; (c) collect or track the personal information of others without a lawful basis; (d) spam, phish, pharm, scrape, pretext, or otherwise misuse the Services; (e) use a robot, spider, scraper, data-gathering or extraction tool, automated device or process, artificial intelligence tool (including agentic AI), or automated or manual method to access or use the Services in a manner not expressly authorised by us; or (f) interfere with, bypass, or circumvent security or authorisation features, robot exclusion headers, access controls, or other measures used to restrict access to the Services.

We may suspend, disable, or terminate access to the Services if we reasonably determine that you have violated these Terms, subject to any notice or remedy required by applicable law.

Section 14 — Agents

14.1 This section (the “Agent Terms”) applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. “Agent” means software or a service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or entity and that can operate on behalf of, or through, a person’s device without direct supervision.

14.2 No Agent may access, use, or interact with the Services unless it identifies itself at all times and operates in strict accordance with Section 14.4. No Agent may access, use, or interact with the Services if we have requested that the Agent refrain from doing so.

14.3 We may limit, including through technical measures, whether and how an Agent accesses, uses, or interacts with the Services.

14.4 Agents must: (i) identify every HTTP or HTTPS request as originating from an Agent and disclose the Agent’s name by including “Agent/[agent name]” in the request’s user-agent string; (ii) not conceal or obscure that access, use, or interactions originate from an Agent, including by mimicking human behaviour or interaction patterns or by completing or circumventing CAPTCHAs or other measures intended to distinguish computer use from human use; (iii) answer truthfully any question or prompt intended to determine whether an interaction originates from a human or a computer; and (iv) not bypass or avoid measures intended to block, limit, modify, or control whether or how Agents access, use, or interact with the Services.

Section 15 — Termination

We may terminate these Terms or suspend or terminate your access to all or part of the Services if you breach these Terms, create risk or possible legal exposure for us, or where otherwise permitted by applicable law. You remain liable for all amounts properly due up to the effective date of termination.

The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provision that by its nature should survive.

Section 16 — Disclaimer of Warranties

Information presented through the Services is provided for general information only. We do not warrant that this information is always accurate, complete, or useful. Any reliance you place on it is at your own risk, except where applicable law provides otherwise.

EXCEPT AS EXPRESSLY STATED BY BSZN OR REQUIRED BY APPLICABLE LAW, THE SERVICES AND PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

Some jurisdictions do not permit the exclusion of certain warranties or conditions. In those jurisdictions, the exclusions above apply only to the extent permitted by law. Nothing in this section affects any statutory warranty, guarantee, or other consumer right that cannot lawfully be excluded.

Section 17 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BSZN, OUR AFFILIATES, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR SHOPIFY OR ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES, ANY PRODUCT PURCHASED THROUGH THE SERVICES, ANY ERROR OR OMISSION IN CONTENT, OR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF CONTENT OR A PRODUCT MADE AVAILABLE THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in these Terms excludes or limits liability to the extent that doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, wilful misconduct, or death or personal injury caused by negligence where such liability cannot lawfully be excluded.

Section 18 — Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless BSZN, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party losses, damages, liabilities, and claims, including reasonable legal fees, arising from: (i) your material breach of these Terms or documents incorporated by reference; (ii) your violation of applicable law or a third party’s rights; or (iii) your unlawful or unauthorised access to or use of the Services.

We will notify you of an indemnifiable claim. A delay in notice will relieve you of your obligations only to the extent the delay materially prejudices your defence. We may control the defence and settlement of the claim at your expense, including the choice of counsel, but we will not settle a claim in a way that imposes a non-monetary obligation on you without your consent, which must not be unreasonably withheld. You agree to provide reasonable cooperation in the defence of an indemnified claim.

Section 19 — Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable portion will be deemed severed. The remaining provisions will remain valid and enforceable.

Section 20 — Waiver; Entire Agreement

Our failure to exercise or enforce a right or provision under these Terms does not constitute a waiver of that right or provision.

These Terms and any policies or operating rules posted by us in relation to the Services constitute the entire agreement between you and us concerning your use of the Services and supersede prior or contemporaneous agreements, communications, and proposals, whether oral or written, concerning that subject matter.

Any ambiguity in these Terms will not automatically be interpreted against the party that drafted them.

Section 21 — Assignment

You may not delegate, transfer, or assign these Terms or your rights or obligations under them without our prior written consent. Any attempted transfer without consent is void to the extent permitted by law.

We may transfer or assign these Terms and our rights and obligations in connection with a merger, acquisition, corporate reorganisation, sale of assets, or transfer of the BSZN business, provided that the transfer does not reduce any consumer right that cannot lawfully be reduced. We will provide notice where required by applicable law.

Section 22 — Governing Law and Jurisdiction

These Terms and any separate agreement through which we provide the Services are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-laws principles.

Subject to any mandatory law that applies to you, the courts of the Hong Kong Special Administrative Region have exclusive jurisdiction over disputes arising from or relating to these Terms or the Services. If you are a consumer, nothing in this section deprives you of any mandatory protection or right to bring proceedings in another competent court that cannot lawfully be excluded under the laws of your place of residence.

Headings are included for convenience only and do not limit or otherwise affect these Terms.

We may update, change, or replace part of these Terms by posting a revised version on our website. We will provide notice of material changes where required by applicable law. Changes take effect on the date stated in the revised Terms or notice. Changes will not affect an order accepted before their effective date unless required by law or agreed with you.

Your continued use of the Services after revised Terms take effect constitutes acceptance of those changes, to the extent permitted by applicable law. If you do not agree to the revised Terms, you must stop using the Services.
